App Terms and Conditions

1. Ownership

These terms establish the general conditions of use of the Symmetry Club application, owned by Symmetry Club LLC, EIN 38-4341052, with address for notices at 8 The Green STE A, Dover, 19901, Delaware, USA.

Registration and use of the application require the user's prior acceptance of these terms. Downloading and using the application grants the status of user and implies that the user has read, understood, and accepted these terms.

2. Minors

To protect minors' privacy, users must be over fourteen (14) years old or have express authorization from their parents or legal guardians to register, access, and use the application. Symmetry Club LLC may request documents to verify identity, age, or authorization.

3. Intellectual property rights

The application is composed of integrated and inseparable elements, including text, illustrations, photographs, animated images, videos, and software. Intellectual property rights belong to Symmetry Club LLC or its licensors, except for materials obtained under license or authorization from third parties.

The user does not acquire any right or license over the software necessary to provide the service, except for the rights strictly necessary to use the application during the term of service.

4. User-generated content

The user remains the owner of intellectual property rights over content generated during use of the application. When the user shares or publishes content in the application, the user grants Symmetry Club LLC a non-exclusive, transferable, free license to store, reproduce, distribute, modify, maintain, or publicly communicate that content as necessary for the service.

If the user shares content not created by the user, the user is solely responsible for having obtained the necessary authorizations from the lawful authors.

5. User obligations

• Use the application and its content in accordance with the law, morality, public order, and these terms.
• Do not use the application for unlawful activities or activities that infringe third-party rights or intellectual or industrial property rules.
• Do not transmit or upload unlawful, misleading, discriminatory, violent, obscene, abusive, xenophobic, defamatory, or otherwise inappropriate content.
• Do not introduce viruses, malicious code, or activities that may alter the proper operation of the application.
• Do not collect or use personal data, including images, from other users without express consent or contrary to applicable data-protection rules.

6. Limitation of liability

Symmetry Club LLC does not guarantee that use of the application will be free of failures, errors, imperfections, problems, or delays. Where Symmetry Club LLC has acted with due diligence, it will not be liable for losses not caused by a breach of these terms, losses not reasonably foreseeable by the parties, or content published by other users that violates rights or is unlawful, violent, offensive, or inappropriate.

7. Personal data protection

Any personal data provided through use of the application will be processed in accordance with the Symmetry application privacy policy and applicable data-protection regulations.

8. Changes

Symmetry Club LLC may make changes it considers appropriate for proper operation of the application, including changing, deleting, or adding content and services and how they are presented. Continued use of the application after changes implies acceptance of the updated terms.

9. Legal actions

If the user breaches these terms, Symmetry Club LLC may take legal action permitted by applicable law and seek any appropriate compensation. Symmetry Club LLC will pursue misuse of the application or its content and infringements of its intellectual and industrial property rights.

10. Guidance statements and advertised results

Statements about muscle gain or other physical benefits are for guidance only. Results are based on studies, historical data, and user testimonials under ideal conditions, but depend on individual factors such as genetics, starting point, adherence, diet, rest, and other circumstances. No specific result is guaranteed.

The aesthetic analysis feature that provides an aesthetic score from a photo is informational and subjective. It is not a medical diagnosis or objective assessment of physical condition, and it should not be the sole basis for health, diet, or training decisions.

All information, advice, and assessments are provided as is and as available, without express or implied warranties of accuracy, truthfulness, suitability, or reliability for any particular purpose.

11. Specific limitation of liability for results and assessments

To the fullest extent permitted by applicable law, Symmetry Club LLC will not be liable for damages arising from the use, interpretation, or application of guidance about physical results or aesthetic assessments obtained through the application.

The user understands that assessments and advertising results are not binding and should not be considered professional medical, nutritional, sports, or other advice. Any decision based on such information is the user's sole responsibility.

12. Consent to share consumption data with Apple

By using the app and making in-app purchases, the user consents to Symmetry sharing data regarding usage and consumption of purchased content with Apple as part of efforts to resolve refund requests. This may include details about how purchased content was accessed and used and is shared only as necessary and in compliance with Apple policies.
